Ch’ien (“Ch’ien,” “we,” “us,” or “our”) operates becomethecreative.com and the related Ch’ien website, online store, marketplace, community features, forms, communications, product-discovery experiences, and other services that link to or reference this Privacy Policy (collectively, the “Services”).
Ch’ien is based in Richmond, Virginia, United States. Our ecommerce Services are powered in part by Shopify. We also use selected third-party platforms and technologies to operate the Services, process transactions, communicate with customers, fulfill orders, prevent fraud, understand how the Services are used, improve product discovery, collect reviews, measure advertising, and market Ch’ien.
This Privacy Policy explains the categories of personal information we collect or process, the sources of that information, why and how we use it, when and with whom it may be disclosed, how long it may be retained, and the privacy choices and rights that may be available to you.
Please read this Privacy Policy carefully. By accessing or using the Services, you acknowledge that you have been provided this Privacy Policy and understand the practices described in it. Where consent is required by applicable law, we will request consent separately rather than relying solely on your use of the Services.
Your use of the Services may also be subject to our Terms of Service, shipping terms, refund or return policy, Community terms, Seller terms, and other policies or notices made available through Ch’ien.
1. Personal Information We Collect or Process
For purposes of this Privacy Policy, “personal information” or “personal data” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked to an individual or household, where applicable.
Personal information does not include information that has been lawfully aggregated, anonymized, or de-identified so that it can no longer reasonably be associated with an identifiable individual.
Depending on how you interact with the Services, we may collect or process the following categories of information:
Contact and identity information
This may include your name, email address, telephone number, billing address, shipping address, country, state or region, postal code, and other information you provide to identify or contact you.
Account information
This may include account identifiers, login credentials, saved preferences, settings, wishlists, authentication information, and information associated with a Shopify or Shop account where applicable.
Transaction and commercial information
This may include products or collections you view, search for, save, add to or remove from a cart, purchase, return, cancel, review, or otherwise interact with; order history; discounts; transaction value; fulfillment information; delivery status; and other commercial interactions with Ch’ien.
Payment-related information
Payments are generally processed by Shopify Payments or other payment providers made available through the Services.
We may receive limited payment-related information such as payment method type, payment status, transaction identifiers, confirmation information, and portions of payment details necessary to identify or service a transaction.
Ch’ien does not intentionally store complete payment-card numbers or card security codes unless expressly disclosed and lawfully permitted.
Communications
We may collect information you provide when contacting Ch’ien, including emails, customer-service requests, form submissions, responses to surveys, feedback, inquiries, complaints, or other communications.
Community and submission information
If you apply to, participate in, or submit material to the Ch’ien Community, we may collect information you voluntarily provide, such as your name, biography, creative interests, profile information, social links, photographs, artwork, product information, descriptions, portfolio material, application responses, or other submitted content.
Some Community information may be intended for public display. We will distinguish public-facing information from information intended solely for internal review where reasonably practicable.
Reviews and user-generated content
If you submit a review, photograph, video, testimonial, comment, profile, artwork, product description, or other material for publication, that material and information associated with it may become publicly visible.
Device and technical information
This may include IP address, browser type, browser settings, operating system, device type, language, network information, cookie identifiers, advertising identifiers, session identifiers, and other unique or technical identifiers.
Usage and browsing information
This may include pages viewed, products viewed, searches, clicks, referral sources, interactions with collections, cart activity, checkout activity, dates and times of visits, session information, and how you navigate or interact with the Services.
Marketing and advertising information
This may include marketing-subscription status, campaign interactions, email engagement where available, advertising identifiers, attribution data, information about whether an advertisement resulted in a visit or transaction, and preferences related to promotional communications or targeted advertising.
Approximate location information
We may infer an approximate location from information such as your IP address or shipping information.
We do not intentionally collect precise geolocation for advertising purposes unless we separately disclose that practice and obtain any consent required by law.
Inferences and recommendations
We, Shopify, or other service providers may derive limited inferences from information such as browsing activity, purchase history, preferences, and interactions to provide recommendations, personalize shopping experiences, improve merchandising, measure advertising, or improve the Services.
2. Sensitive Personal Information
We do not intentionally request sensitive personal information that is unnecessary to provide the Services.
Please do not submit information concerning health conditions, biometric identifiers, government-issued identification numbers, precise geolocation, racial or ethnic origin, religious or philosophical beliefs, sexual orientation, citizenship or immigration status, or other legally protected sensitive information through general forms, reviews, Community biographies, or public submissions unless it is reasonably necessary and specifically requested.
If we need to process information that constitutes “sensitive data” or “sensitive personal information” under applicable law, we will process it only as permitted by law and obtain consent where legally required.
3. How We Collect Personal Information
We may collect personal information from the following sources.
Directly from you
We collect information when you purchase a product, create or use an account, subscribe to marketing, communicate with us, submit a form, apply to or participate in the Community, submit content, leave a review, or otherwise provide information to Ch’ien.
Automatically through the Services
We may automatically receive information from your browser or device and through cookies, pixels, local storage, server-side events, software development kits, and similar technologies when you interact with the Services.
Shopify and commerce providers
We may receive information from Shopify and related Shopify services used to operate Ch’ien, including information concerning transactions, customers, accounts, fraud prevention, product interactions, Shop, marketing, analytics, or fulfillment.
Advertising, analytics, and technology providers
We may receive information from providers that assist with advertising, analytics, attribution, fraud prevention, communications, site performance, product recommendations, or related technology.
Social-media platforms
If you interact with Ch’ien through Facebook, Instagram, or another social platform, we may receive information permitted by that platform and your settings.
Service providers and business partners
We may receive information from payment processors, shipping providers, marketing partners, contractors, technology providers, professional advisers, and other parties that assist us.
Publicly available or user-directed sources
Where lawful and appropriate, we may receive information that you have made publicly available or directed another person or service to provide to us.
4. How We Use Personal Information
We may use personal information for the following purposes.
Providing and operating the Services
We use information to provide, operate, maintain, and administer Ch’ien and its related Services.
Processing transactions
We use information to process payments, complete purchases, issue confirmations, facilitate fulfillment and shipping, address order issues, process permitted refunds or other adjustments, and maintain transaction records.
Customer accounts and personalization
We may use information to create and administer accounts, remember preferences, display saved products, provide personalized recommendations, and improve the relevance of products or content shown to you.
Customer service and communications
We use information to answer questions, respond to requests, provide customer support, communicate about orders, send important account or policy notices, and maintain our relationship with customers and Community members.
Marketing
Where permitted by law, we may use information to send promotional communications about Ch’ien, newly available products, Community activity, announcements, events, or other information we believe may be relevant.
Marketing automation
Where permitted by applicable law and your preferences, our systems may send or facilitate communications based on interactions with the Services, including welcome messages, abandoned-browse communications, abandoned-cart communications, abandoned-checkout communications, post-purchase messages, review requests, or related communications.
Advertising and attribution
We may use information to advertise Ch’ien, measure advertising effectiveness, determine whether an advertisement resulted in a website visit or purchase, improve advertising campaigns, create or measure advertising audiences where permitted, and understand how customers discover Ch’ien.
Analytics and improvement
We may use information to understand how visitors interact with the Services, identify trends, measure performance, troubleshoot issues, improve navigation, improve product discovery, develop new features, and improve Ch’ien’s operations.
Fraud prevention and security
We may use information to authenticate transactions or accounts, detect suspicious behavior, prevent fraud, investigate abuse, secure the Services, and protect Ch’ien, our customers, Community members, service providers, and others.
Legal and compliance purposes
We may process information as reasonably necessary to comply with applicable law, respond to lawful requests, maintain required records, enforce agreements and policies, establish or defend legal claims, respond to disputes, or protect legal rights.
5. Shopify
Ch’ien uses Shopify to provide substantial portions of the ecommerce infrastructure supporting the Services.
Shopify may process information concerning your access to and use of Ch’ien in order to provide checkout, payments, customer accounts, fraud prevention, analytics, product discovery, marketing, communications, Shop functionality, review functionality, and other commerce services.
Information that you submit to Ch’ien may therefore be transmitted to and processed by Shopify and Shopify’s service providers.
In certain circumstances, Shopify acts as a service provider or processor for Ch’ien. In other circumstances, Shopify may independently determine the purposes and means of processing and be responsible for that processing under its own privacy terms.

6. Shopify Network Intelligence and Enhanced Services
Ch’ien may use Shopify services that rely on Shopify Network Intelligence.
When Shopify Network Intelligence is enabled, Shopify may use information concerning interactions with Ch’ien together with information concerning interactions with Shopify and other merchants to provide enhanced commerce services.
These services may include improved personalization, fraud prevention, product discovery, store performance, marketing measurement, advertising effectiveness, or related features.
Shopify may process information for these services under its applicable terms and privacy documentation.
Where Shopify-supported privacy controls apply, customer choices submitted through an applicable cookie-consent mechanism, a Shopify data-sharing opt-out page, Global Privacy Control, or other compatible privacy-control mechanism may affect Shopify’s use of information for advertising or other non-essential purposes.
7. Shop and Shopify-Powered Discovery
Ch’ien participates in or may use Shopify-powered product-discovery and commerce services, including the Shop channel, Shop storefront functionality, Shop product recommendations, Shop advertising or acquisition services, and related Shopify commerce surfaces.
Shopify may use store information, catalog information, customer interactions, purchase information, and other information as permitted by its applicable terms to provide these features.
If you interact directly with Shop or another Shopify-controlled experience, Shopify may separately collect and process information under Shopify’s own privacy policies.
8. AI-Assisted, Automated, and Agentic Shopping Experiences
Public Ch’ien store information, including product listings, product images, descriptions, prices, availability, policies, FAQs, and other public-facing store information, may be made available through automated shopping, artificial intelligence, recommendation, search, or agentic commerce experiences supported by Shopify or other platforms that Ch’ien chooses to participate in.
These technologies may help shoppers discover, compare, evaluate, or navigate Ch’ien products.
Interactions occurring directly through a third-party artificial intelligence or automated-shopping service may be processed by the provider of that service in accordance with its own privacy terms.
Ch’ien does not currently use solely automated decision-making to make decisions about individuals that produce legal or similarly significant effects.
If that practice changes, we will update this Privacy Policy and provide any additional rights or notices required by applicable law.
9. Meta, Facebook, and Instagram
Ch’ien uses Facebook and Instagram services provided by Meta for catalog distribution, product discovery, advertising, measurement, attribution, and marketing.
Our Shopify store is configured to use Meta advertising and measurement technologies that may include:

Depending on your interaction with Ch’ien, applicable law, our configuration, and your privacy choices, information transmitted or made available through these technologies may include:

Certain identifiers may be normalized, hashed, or otherwise transformed before transmission for matching purposes. Hashing does not necessarily remove information from the definition of personal information under applicable privacy law.
Meta processes information it receives under its own terms and privacy policies and may associate information received through its Business Tools with other information available to Meta as permitted by law and Meta’s policies.
Ch’ien does not intentionally transmit complete payment-card numbers or card security codes to Meta for advertising purposes.
10. Other Advertising, Analytics, and Marketing Providers
Ch’ien may use additional advertising, analytics, social-media, search, or measurement services where appropriate.
These may include services offered by Shopify, Meta, Google, Microsoft, or other providers.
The specific technologies active on Ch’ien may change as the business evolves.
Where required by applicable law, we will update our privacy disclosures or consent mechanisms when new technologies materially change how personal information is collected, used, or disclosed.
11. Targeted Advertising, Sale, and Sharing
We may process personal information to advertise Ch’ien and to measure, personalize, or improve advertising.
We do not sell personal information to third parties in exchange for money.
However, certain U.S. privacy laws define “sale,” “sharing,” “targeted advertising,” or similar terms more broadly than an exchange of personal information for money.
For example, making identifiers, internet activity, device information, or commercial information available to an advertising platform so that advertisements can be selected or measured may be considered “sharing,” a “sale,” or processing for “targeted advertising” under certain laws.

Where required and technically supported, we also honor recognized browser-based opt-out preference signals, including Global Privacy Control.
Your choices may apply to the browser or device from which the signal or request is received unless applicable technology or law permits us to associate that choice with you more broadly.
12. Global Privacy Control
Global Privacy Control, or GPC, is a browser or device signal that communicates a request to opt out of certain sale or sharing of personal information or targeted advertising.
Where applicable law requires recognition of GPC and our technology supports it, Ch’ien and compatible Shopify privacy technologies will treat a recognized GPC signal as an applicable opt-out request for that browser or device.
You do not need to create a new Ch’ien account solely to submit an applicable privacy-rights request.
13. Cookies and Similar Technologies
Ch’ien, Shopify, Meta, and other providers may use cookies, pixels, local storage, server-side events, software development kits, and similar technologies.
These technologies may be used for:

Blocking or deleting certain technologies may prevent portions of the Services from functioning as intended.
14. Cookie Preferences and Consent
Where a cookie banner or preference center is available, you may use it to manage applicable categories of non-essential data collection.

You may unsubscribe from promotional emails at any time by using the unsubscribe mechanism provided in the communication.
If text-message marketing is offered, any applicable consent and opt-out rules will be provided when you subscribe.
Opting out of marketing does not prevent Ch’ien from sending transactional or service communications reasonably necessary to administer an order, account, inquiry, legal notice, or other existing relationship.
16. Reviews
Shopify, Shop, Ch’ien, or an integrated review provider may request feedback following an eligible purchase.
A review may include a rating, text, photograph, video, or other content you choose to submit.
Reviews may be associated with a verified purchase when supported by the applicable platform.
If published, a review may be visible to the public through Ch’ien, Shop, or other supported commerce surfaces.
Please do not include information in a public review that you do not want publicly accessible.
17. Community Profiles and Public Content
Ch’ien is intended in part to provide a space for creative individuals and their work.
Information intentionally submitted for inclusion in a public Community profile may be publicly displayed.
This may include a chosen name, biography, photographs, creative work, portfolio material, social links, descriptions, products, or other content the participant chooses to make public.
Public information may be copied, shared, indexed, or viewed by other people outside Ch’ien’s control.
Do not submit confidential information, private contact information, sensitive personal information, or third-party material you do not have permission to make public.
Information submitted solely for application review, administration, seller onboarding, payment, tax, or internal communications is not intended to be made public unless otherwise disclosed.
18. How We Disclose Personal Information
We may disclose personal information to the following categories of recipients where reasonably necessary for the purposes described in this Privacy Policy.
Shopify
We disclose information to Shopify to operate our ecommerce Services and use Shopify services.
Payment providers
Payment information and transaction information may be disclosed to payment processors, banks, card networks, fraud-prevention providers, and other parties necessary to process transactions.
Shipping and fulfillment providers
We may disclose names, delivery addresses, contact information, order details, and other necessary information to shipping, delivery, fulfillment, and logistics providers.
Technology and hosting providers
We may use providers for hosting, data storage, site operation, communications, customer support, analytics, security, backups, and other technical functions.
Advertising and marketing providers
We may disclose relevant identifiers, device information, browsing information, commercial information, or advertising information to advertising or marketing partners such as Meta where permitted by law and subject to applicable privacy choices.
Professional advisers
We may disclose information to attorneys, accountants, insurers, auditors, consultants, or similar advisers when reasonably necessary.
Community sellers or collaborators
Where a transaction, inquiry, Community relationship, fulfillment arrangement, or other service requires participation from a Community seller or collaborator, we may provide only the information reasonably necessary for that person to perform the applicable role.
Authorities and legal recipients
We may disclose information if reasonably necessary to comply with law, respond to valid legal process, enforce agreements, investigate suspected misconduct, prevent harm, or protect the rights of Ch’ien or others.
Business transactions
Information may be disclosed in connection with a merger, acquisition, financing, restructuring, bankruptcy, sale of assets, or similar business transaction, subject to applicable law.
At your direction
We may disclose information when you direct us to do so or otherwise provide valid consent.
19. Data Minimization
We seek to collect, use, and retain personal information that is reasonably appropriate for the purposes described in this Privacy Policy.
We do not intentionally collect personal information merely because it may be technically possible to do so.
20. Data Retention
We retain personal information for as long as reasonably necessary for the purposes for which it was collected or processed.

No website, network, transmission, or storage system can be guaranteed to be completely secure.
You are responsible for maintaining the confidentiality of passwords and account credentials under your control.
If you believe your interaction with Ch’ien is no longer secure, contact us promptly.
22. Data Breaches and Security Incidents
If Ch’ien becomes aware of a security incident involving personal information, we will investigate the incident and take actions we determine reasonably appropriate.
Where applicable law requires notification to affected individuals, governmental authorities, or other parties, we will provide such notification in accordance with applicable legal requirements.
23. International Data Transfers
Ch’ien is based in the United States.
Shopify, Meta, and other service providers may operate or use service providers in the United States, Canada, the European Economic Area, the United Kingdom, or other jurisdictions.
Personal information may therefore be transferred, stored, or processed outside the jurisdiction where you live.
Privacy and data-protection laws in those jurisdictions may differ from those in your jurisdiction.
Where applicable law requires a recognized mechanism for international transfers, the applicable controller or processor will use an appropriate legal mechanism.

Ch’ien may use or receive automated recommendations, product-ranking tools, advertising optimization, fraud-detection tools, or similar automated technology.
These tools may analyze interactions or transaction information to provide recommendations, prevent fraud, improve marketing, or improve Services.
Ch’ien does not currently use profiling to make decisions about customers that produce legal or similarly significant effects.
If this changes, we will provide any notices and opt-out rights required by applicable law.
31. Children and Minors
The Services are not directed to children under 13, and Ch’ien does not knowingly collect personal information from children under 13 in violation of applicable law.
Where applicable law provides heightened protections to minors, we will comply with those requirements.
We do not knowingly sell or share personal information of individuals under 16 for targeted advertising in circumstances where applicable law requires authorization and that authorization has not been obtained.

32. Third-Party Websites, Applications, and Social Platforms
The Services may link to websites, applications, embedded services, payment services, social-media platforms, AI services, or other third-party properties that Ch’ien does not control.
Third parties maintain their own privacy and security practices.
This Privacy Policy does not govern personal information that you provide directly to an independent third party.
We encourage you to review the privacy policies of third-party services before providing information to them.
33. Social Media
When you interact with Ch’ien through Facebook, Instagram, TikTok, Pinterest, YouTube, or another social-media service, information relating to that interaction may be processed by the social platform according to its privacy practices.
Content you post publicly or tag Ch’ien in may also be visible to other users.
34. Do Not Track Signals
Some browsers offer a “Do Not Track” setting.
There is not currently a universally accepted technical standard governing all Do Not Track signals.
